Judge Berdote Byrne denied appeals made by Wallace and ordered him to comply with her previous decision on June 3, 2019. She cautioned that if he did not comply with the order, further actions could be taken by the court.
The second reading was held on 6/17/19, with 100% approval for advancement to a vote in the full Senate. On 6/20/19 the Senate voted and passed the bill with a few amendments.
As of last week the attorney for the defendant did not file any opposition to the Order to Show Cause, so there were no oral arguments heard in Morristown on May 30, 2019. Court was held in Gillette today. Zoning Officer Alison Larocca was cross examined by Wallace’s attorney Morrison. Vernon Police officers also testified. Court was dismissed by judge. New date will be posted for Wallace to testify.
5/30 court oral arguments have been cancelled due to Wallace’s attorney, Patti, not filing paperwork in a timely fashion. Judge Byrne will make her decision based on what she currently has. No date given for decision release.
Senate Bill 1683 is sitting in Appropriations, waiting for legislators to determine predicted costs and revenues for the state if this bill passes.
